Daniels "disgusted" with song in Guitar Hero III

Posted on April 8th, 2008 at 04:04 EDT

American country musician Charles Daniels has said that he is “disgusted” with the portrayal of his song “The Devil Went Down to Georgia” in Activision’s music simulation title, Guitar Hero III.

Daniels, 71, noted that he had not granted permission for the song to be included in the title, as he had previously lost publishing rights to the composition some years earlier.

The song itself is depicted in the game being performed whilst surrounded by various images of devilry.

Speaking in a statement on his official website, Daniels commented, “I want any of you parents out there whose children have this game to know that I did not grant these people my permission to pervert my song and am disgusted with the result.”

“Unfortunately I lost the publishing rights on the song many years ago in a settlement with a former partner and the license to Guitar Hero was granted by the company who now owns the publishing.”

“I would never grant permission for some company to create a video game version of a song I wrote in which the devil wins a contest and I’m sorely disappointed with the company who owns the copyright for not policing the situation. As it is they have allowed these people to violate the very essence of the song."

No doubt he'll be looking to ban the game or something, I just dont understand people, how long has Guitar Hero been out now ?

Why should it bother him if he's got no right's to the song?

Maybe he got a best of Album due out and he's looking for some publicity.

PSN ID: Silencer_87...You shouldn't have lost your publishing rights then.

I wonder what are Lord Gingo's thoughts on this?

The Devil only wins if you suck. Or play Expert. I can not finish that song on expert!

An artist not owning his/her own music's publishing rights is a small example of everything that's wrong with the corporate world.  I don't like country rock, but Charlie Daniels is good people (hear now, in his old age).  I think it's funny that you people that are on Charlie Daniel's case are the same one's that cry foul when EA uses IT'S corporate strongarm tactics.  Learn a little before you post.  You are such sheep.  All I hear is Baaa and Waaa...

It does suck for him though.

It's like if you wrote and sang a very happy song and it got used in an event or something that you wouldn't consent to...say some sort of "gay" convention (not that there's anything wrong with that!) which you wouldn't support or against.  But if you've lost your publishing rights for some reason...then tough!

Odium_Generis_Humani :? And what has him loosing his publishing rights got to do with EA, maybe you should read the posts better yourself before you post.

How EA use the song is irrelevant. They ask permission form the copyright holder and tell them how it is to be used they said yes, so how can EA be blamed for Charlie surrendering his rights to the track years ago ?  If it was your music would you not have made a complaint long before now regardless of who owned the copyright ?

Hmm... you write a song about the devil winning a contest, and then you want to bash other people for "perverting" it? How bizarre! Pot, kettle, black mate... you shouldn't have written the song.

@ Orbilator Why should it bother him? Well maybe because he wrote the song and someone used it out of context. @Paranoimia If you've ever listened to the song, you'd realize it's not about the devil winning a contest. He loses to Johnny.

The song is like about a devil, the “devil“ went down to georgia !?!

@Paranoimia

In the original song the devil does NOT win the contest.  He loses the contest to Johnny and has to give up a fiddle made of gold.  Trust me... I was born and raised in Georgia and actually attended the duel in the middle of the Okeefenokee swamp...

@ wufei - Well, you're right, I haven't deliberately listened to the song, since I detest country music. That said, firstly this isn't a fiddle-playing contest, and secondly 'the devil' doesn't win here either, since the player is - presumably - human, and... well... IT'S JUST A GAME!

Besides which, since the devil doesn't actually exist, it's all irrelevant.

maybe the catholic church will complain since u get to play as god in gh3...

"we did not give permission for our god to be used in this video game and the way he is portrayed to be a rockin guitarist is disgusting"

I'm sorry but if you think about it the song is about the Devil lossing the fight.   If you win then the song is true.  If you lose then the song is false.  But thats just cause you suck.   I think the song worked great!  Doesn't offend me at all maybe its just cause he is 71 and everything offends older people.

@Orbilator

This is what I mean by "Learn a little...".  I forgot that EA actually makes GH.  I didn't bring them up for their DIRECT involvement with the song, my aim was to make an analogy to what everyone hates (or should hate) about EA's corporate "own everything" way of doing business (NFL, Take Two, etc.), like a record company's (see where I'm going now?).  There are few things sadder than an artist not owning his/her art.  But a music publisher doesn't care, just like EA.  That's what I mean.  My analogy has nothing to do with the game itself.  To review, I questioned how many of you can come down on EA for their business practices, but then defend whoever owns the rights to "The Devil Went Down to Georgia".

@Paranoimia

I also detest country music... but knowing that song is absolutely unavoidable if you live in the south... especially Georgia.  I'm also a practicing Theradavan Buddhist and you're right... the devil is irrelevant and is used in "fire and brimstone" sermons by churches in the south to scare ignorant rednecks into putting more money into the offering plate.  Interesting fact:  My hometown high school's mascot is a demon... they're known as the Warner Robins Demons.  Apparently they too signed a pact with the devil as they've won several state, regional, and national championships...

This is stupid, why does he care anyway if he lost publishing rights? Brilliant song, but just because you play it when your facing the devil doesn't mean its a devil song... =-]

He has a right to be pissed. He made a song that was taken from him and because of how patent rights are these days. It got turned into something he doesn't like. And the sad part is that he cant' do a thing about it.

I'd be pissed too if what I envisioned and made with my own hands got taken away from me and used for profit by someone else who took what you and and made it something entirely different, perhaps offensive. Hence the word "perverted".

I can sympathize with him, irregardlessly I love the GH Mix "The Devil Went Down to Georgia" and I listen to it occasionally.

notice how he said he lost the publishing,,,, which means he sold it not thinking it would ever make these types of mechanical royalties,,,, which also means he probably wont get any of the money they make from his catalouge with a resurged interest from the younger GH audience (cause he probably "lost " that too). Bottom line I think CD is just pissed off someone else profiiting off his intellectual property and him not getting in on the action.

lol @ billy_bob. Well, it sucks for him, but hey they could have done an emo version of the song lol. I personally like the remix. What disgusts me is that I have beaten every guitar hero song ever made (on expert) except this one because battle mode is so gay. Seriously Activision, (not EA) Battle Mode should be optional as it doesn't determine actual skill needed to beat songs. I want to unlock dragonforce damnit!

@Orbilator

are you english or retarded?   hm... last i checked,  E.A.  had no connection to the creation of Guitar Hero.  Or maybe you can explain the rumor or fact, rather, that it was developed with a combination of neversoft, activision, and red octane.
